CMS Utility Services, Inc. (“CMS,” “we,” “our,” or “us”) is a utility infrastructure company with over 40 years of experience serving electric cooperatives, municipal utilities, investor owned utilities, and government agencies across the United States. We design, build, install, and maintain pole yards, pole racks, and related utility infrastructure solutions. This Privacy Policy describes how CMS collects, uses, discloses, and protects information gathered through our website at www.cmsus.com (the “Site”) and through any contact forms, inquiry submissions, or communications initiated through the Site. By using the Site, you agree to the terms of this Privacy Policy. If you do not agree, please discontinue use of the Site.

We collect information in two ways: directly from you when you contact us, and automatically through standard website technologies.

1.1 Information You Provide Directly

CMS collects information when you use our contact form, email our team directly, or call our offices. The types of information we may collect include:

  • Job title and professional role (e.g., Facilities Manager, Purchasing Agent, Yard Manager)
  • Business email address and phone number
  • Project location and service interest (e.g., pole yard design, emergency rack deployment)

Because our clients are utility companies, cooperatives, and government agencies, information submitted through the Site is typically business contact information rather than personal consumer data. We do not collect payment information, Social Security numbers, or personal financial data through the Site.

1.2 Information Collected Automatically

Our Site may use standard web technologies that automatically collect: IP address and approximate geographic location; browser type, version, and operating system; device type; pages visited and time spent on each; referring URL; date and time of each visit; and video interaction data where video content is embedded. This data is used in aggregate to understand how visitors interact with the Site and is not used to individually identify visitors without additional context.

1.4 Contact Form Platform

Our contact form is processed through Keap (formerly Infusionsoft), a third-party customer relationship management platform. When you submit the contact form, your information is transmitted to and stored within the Keap platform. Keap’s own privacy policy governs the processing of your data on their platform. CMS uses Keap to manage inquiry follow-up and client relationship management.

2. How We Use Your Information

CMS uses information collected through the Site to respond to project inquiries and consultation requests; to provide free pole yard design assessments to prospective and existing clients; to follow up on requests for quotes; to maintain records of client communications and project history; to improve the content and performance of the Site; and to comply with applicable federal, state, and local laws and regulations. CMS does not use your information for automated decision-making, consumer profiling, or behavioral advertising. We do not sell personal information to data brokers or advertising networks.

3. How We Share Your Information

CMS does not sell or rent personal information. We share information only in the following limited circumstances.

3.1 Service Providers

We use third-party vendors to operate the Site and manage business communications, including our website platform, page builder, and CRM provider. These providers access information only as necessary to provide their services and are subject to appropriate contractual and legal data protection obligations.

3.2 Project Coordination

When a client project requires coordination with subcontractors, material suppliers, or installation partners, limited project-relevant information may be shared with those parties solely for the purpose of delivering the contracted service.

3.3 Legal and Regulatory Obligations

CMS may disclose information when required by applicable law, regulation, court order, or governmental authority. This includes compliance with state and federal environmental regulations governing our EPA containment and filtration services.

3.4 Business Transfers

In the event of a merger, acquisition, or sale of CMS’s business or assets, personal information may be transferred to the acquiring entity. Affected parties will be notified of any such transfer.

CMS retains business contact information and inquiry records for as long as necessary to fulfill the purposes described in this Policy, to maintain business relationships, and to comply with applicable legal and contractual obligations. We securely delete or anonymize personal information when it is no longer required for its original purpose and no applicable legal hold applies.

7. Business-to-Business Context

CMS primarily serves utility companies, electric cooperatives, municipal utilities, and government agencies in a business-to-business capacity. Most information collected through the Site relates to business professionals acting in their organizational role, not as individual consumers. Contact information submitted by utility professionals is used exclusively to respond to project inquiries and maintain client relationships. It is not used for consumer profiling, behavioral advertising, or any purpose unrelated to CMS’s utility services business.

8. Children’s Privacy

The Site is intended exclusively for utility industry professionals and business representatives. CMS does not knowingly collect information from individuals under the age of 18. If we become aware that a minor has submitted information through the Site, we will promptly delete it.
